Electronic End-User Software License Agreement
THIS AGREEMENT IS A LEGAL DOCUMENT. READ IT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THE SOFTWARE. IT PROVIDES A LICENSE TO USE THE SOFTWARE AND CONTAINS WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING THE SOFTWARE, YOU ARE CONFIRMING ACCEPTANCE OF THE SOFTWARE AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT. IF THERE ARE ANY MODIFICATIONS TO THIS ELECTRONIC END-USER SOFTWARE LICENSE AGREEMENT, THERE WILL BE AN ANNOUNCEMENT IN THE USER INTERFACE OF MOBILedit FORENSIC WHERE A USER OR A REPRESENTATIVE OF THEIR ORGANIZATION WOULD BE ABLE TO APPROVE OR REJECT BEFORE UPDATING THE SOFTWARE. IF YOU DO NOT WISH TO DO SO, DO NOT COMPLETE THE INSTALLATION PROCESS. PROMPTLY RETURN THE ENTIRE PACKAGE TO THE PLACE WHERE YOU OBTAINED IT, FOR A FULL REFUND.
1. Definitions
(a) "COMPELSON" means Compelson s.r.o. and its licensors, if any.
(b) "Software" means the programs supplied by COMPELSON herewith, and any and all parts or updates thereto.
2. License
This Agreement allows you to:
(a) Install and use the Software on one computer. You must reproduce on any such copy all copyright notices and any other proprietary legends on the original copy of the Software.
(b) Install the Software on a storage device, such as a network server, and run the Software on an internal network, provided the number of concurrent users does not exceed the number of copies or licenses of the Software purchased. A copy or licenses of the Software must be purchased for each such computer.
(c) If you have purchased a multi-pack license for the Software product or a license to make multiple installations of the Software, you may concurrently use the number of copies of the Software authorized by that purchase.
3. License Restrictions
You may not make or distribute copies of the Software, or electronically transfer the Software from one computer to another or over a network. You may not decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-perceivable form. You may not rent, lease or sublicense the Software. You may not modify the Software or create derivative works based upon the Software.
4. Upgrades
If this copy of the Software is an upgrade from an earlier version of the Software, it is provided to you on a license exchange basis. You agree by your installation and use of this copy of the Software to voluntarily terminate your earlier end-user license and that you will not continue to use the earlier version of the Software nor transfer it to another.
5. Ownership
The foregoing license gives you limited rights to use the Software. Although you own the media on which the Software is recorded, you do not become the owner of, and COMPELSON retains title to, the Software, and all copies thereof. All rights not specifically granted in this Agreement, including Federal and International Copyrights, are reserved by COMPELSON.
6. Distribution
Provided that you are distributing the current non-registered version (select "About" to check) you are hereby granted permission to duplicate and distribute the non-registered version of this Software; give exact copies of the original non-registered version to anyone; and distribute the non-registered version of this Software and documentation in its unmodified form via electronic means. There is no charge for any of the above. You are specifically prohibited from charging, or requesting donations, for any such copies, however made; from distributing the software and/or documentation with other products (commercial or otherwise) without prior written permission.
7. Disclaimer of Warranty
This Software and the accompanying files are sold "as is" and without warranties as to performance of merchantability or any of ther warranties whether expressed or implied. Because of the various hardware and software environments into which COMPELSON Software may be put, no warranty of fitness for a particular purpose is offered.
8. Non-Competitive Agreement
The product cannot be used for competitive purposes in any manner. It is agreed that any reverse engineering, be they direct or created through inspiration, is unlawful and strictly forbidden. Moreover, you agree that in no such manner have you the ability to use our software nor source codes, in whole or in any part, and that in such doing, you will be in violation of our agreement and subject to punishment by law.
9. General
This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
